What happens if you don't have a will when you die?

Your Possessions / Estate

If you are married, your entire estate (including property) will be passed to your spouse up to a certain value. Anything over that value will be split between your spouse and your children or grandchildren.

If you are not married, your entire estate will be passed to your children unless you own your property as joint tenants, in which case your partner will inherit your share.

If you do not have children then things get passed on to your other family, starting with parents and then moving on to brothers and sisters then half-blood siblings.  

Ultimately, you do not get to choose who gets what if you do not have a will in place so to make sure that the right things end up in the right hands you need a will in place.

Your Children

This is the big one! If you die with no will in place the state will decide who is best to look after your children.

This will usually be a family member but if there is no one deemed suitable then children can be taken in to care.

Common choices would be grandparents or other family members but if you have agreed with someone that they will take on the responsibility or you have someone in particular in mind for this huge responsibility then you need to have a will in place to make sure your wishes are followed.

This is someone that you nominate to receive something from your estate. It could be a proportion of everything or it could be just one specific item. 
If it is money being left to a child you will usually also appoint a trustee to look after it for them until you think they are old enough to receive it.

Guardians

Here is the big one, who would you like to look after your children? Obviously this only takes affect if both parents have died but if that is the case, it is the guardian's responsibility to decide how your children should be looked after. That may well be by them or it could be by other family members as they see fit.

In the event of both parents passing away, a lot of our clients will take out an extra life insurance policy that will mean there is plenty of money to be able to give their children the best life possible. That money could be used for anything from general care to private school and university fees.
